Supreme Court stays Sringeri recount decision, restores Raje Gowda as MLA
On May 11, a bench of the Supreme Court headed by Justice Sanjay Kumar ordered a stay on the Sringeri recount result, thereby reinstating Congress leader Raje Gowda as the Member of the Legislative Assembly for the Sringeri constituency in Karnataka. The court also issued a notice to BJP candidate Jeevaraj and other respondents.
The dispute stems from the 2026 Karnataka assembly elections, where BJP’s Jeevaraj was initially declared the winner after a recount that reduced the margin from 2,500 votes to a 49‑vote lead. Congress challenged the recount, alleging procedural irregularities and breaches of the Representation of People Act.
The Hindu reported that the Supreme Court’s order maintains the status quo ante, effectively nullifying the recount outcome pending a full hearing. Justice Kumar wrote, “Given the serious questions raised about the recount process, we find it appropriate to stay the result until the matter is fully examined.” The Election Commission of India, per a separate statement, will cooperate with the court’s directives. Meanwhile, regional media cited a BJP spokesperson saying the party “remains confident in the legitimacy of the recount.”
Legal experts view the decision as a significant test of electoral jurisprudence. “This stay underscores the Supreme Court’s willingness to intervene when procedural fairness is in doubt,” noted Prof. Ananya Rao of National Law School, Bangalore. Political analysts warn that the ruling could influence future recount protocols across Indian states.
The court has scheduled the next hearing for June 15, after which it may either uphold the recount, order a fresh count, or call for a re‑poll. Stakeholders will closely monitor the Election Commission’s compliance and any political fallout in Karnataka’s upcoming legislative sessions.
